近期調查發現有管制代理人將非已知貨物當作已知貨物交付的嚴重缺失。 涉案的管制代理人在未確認收到任何保安檢查收據或貨物保安檢查結果的情況下，錯誤地在主空運提單上註明「已知貨物（SPX）」。 根據《管制代理人通告第6/2021號》，此類行為屬於嚴重缺失，該管制代理人的資格已被暫停。
關鍵合規要求
1. 主動確認保安檢查結果
管制代理人的負責人和貨物保安指定人必須確保職員已檢查由管制空運貨物安檢設施發出的保安檢查收據，方可在裝運單據上註明「SPX」並提交單據。 如未能即時獲取保安檢查收據，可透過電子郵件或其他渠道收到的書面通知確認該票貨物的保安檢查結果。
2. 妥善使用管制代理人身份
管制代理人編號僅可註明於以其管制代理人身份托運貨物的裝運單據上。 如管制代理人被發現不當使用其身份，民航處保留權利暫停或撤銷該管制代理人資格。 涉及欺詐或偽造文件的個案，將交由香港警務處調查。
3. 帳戶管理責任
任何透過使用者帳戶呈交的文件會被視作由持有該帳戶的管制代理人呈交。 因此，管制代理人須就任何違反規定的缺失負責。管制代理人必須確保帳戶的登錄密碼和權限只開放予獲授權的職員，並確保該等職員在主動確認保安檢查結果後才申報貨物的保安狀態。

Important Alert: Regulated Agents Must Ensure Security Screening on Unknown Cargo
CAD Issues New Notice Requiring Strict Compliance with Cargo Security Screening Procedures
Dear Valued Customers,
The Civil Aviation Department (CAD) of Hong Kong issued Notice to Regulated Agents 5/2025 in September 2025, reminding all Regulated Agents (RAs) to ensure proper security screening on unknown cargo. As your trusted freight forwarding partner, we want to share this important compliance update with you.
Notice Background
A recent investigation revealed a major deficiency where RAs were tendering unknown cargo as known cargo. The subject RA declared cargo as Known Cargo without confirming receipt of screening records by annotating “SPX” on Master Air Waybill (MAWB) submitted to aircraft operators. According to Notice to RAs 6/2021, this constitutes a major deficiency, resulting in the suspension of the RA’s status.
Key Compliance Requirements
1. Positive Confirmation on Security Screening Results
Persons-In-Charge (PICs) and Nominated Persons for Cargo Security (NPs) of RAs must ensure their staff checks for screening receipts issued by Regulated Air Cargo Screening Facilities (RACSF) before annotating “SPX” on shipping documents. Alternative written confirmation such as email notifications may be accepted when screening receipts are not immediately available.
2. Proper Use of RA Status
RA codes should only be indicated on shipping documents for shipments under their genuine custody in all circumstances. If an RA is found misusing its RA status, CAD reserves the right to suspend or remove the RA from the register. Cases involving fraud, falsifications, or forgery will be referred to Hong Kong Police Force for investigation.
3. User Account Management
All documents submitted with a user account are considered as submitted by the RA who owns the account, making them responsible for any deficiency arising from non-compliance. RAs must ensure access to login credentials is restricted to authorized staff and that security status is declared only after positively confirming screening results.
